Form a Corporation
Forming a corporation is a smart step for your business. We make it happen smoothly. To get the process started, first decide:
- What type of entity you wish to form
- Which state you wish to form in
Most states don’t require legal representation to form a corporation. But it’s a good idea to consult with your attorney or accountant to discuss your options. American Incorporators does not provide legal or financial advice.
Once you’ve made your decisions, you can begin two ways:
- Incorporate online with our easy to follow instructions
- Let an incorporation specialist take you through the process over the phone
Either way, we’ll need to know:
- Your proposed company name, and one alternative
- Names and addresses of directors/members
- Daytime Phone Number, Fax Number (if you have one) and email address
- Your company’s legal address
- Shipping address (No PO Boxes) if different than above
- Which incorporation package you prefer

What happens next?
It will take you less than 10 minutes to complete the application. After that, we do the rest.
- First, we conduct a thorough search of your proposed name within your chosen state. If a conflict is discovered, we notify you within 24 to 48 hours to request an alternative, if one has not been provided.
- We prepare and file a Certificate of Incorporation or Certificate of Formation. Filing takes about 24 hours in Delaware, and about 48 to 72 hours in other states.
- If you’re forming in Delaware, you should receive your documents within five to seven days. For formations in other states, expect to receive documents within 7 to 10 business days. Expedited service is available for an additional fee, which includes priority handling and overnight delivery of documents, trimming days off normal turnaround times.
One more thing.
Most states require that a company incorporated in that state but located elsewhere have a “registered agent” to forward legal papers and state fees to the corporation.
